Pursuant to Neb. Rev. Stat. Â§ 24-1107 (Cum. Supp. 1992), this court has accepted the petition of Steven W. Childs for our review of the decision by the Nebraska Court of Appeals, namely, State v. Childs, 1 NCA 478 (1992), wherein the Nebraska Court of Appeals affirmed Childs conviction of driving while under the influence of alcohol (drunk driving), in violation of Neb. Rev. Stat. Â§ 39-669.07 (Cum. Supp. 1990). At issue is the refusal of the district court for Douglas County to suppress evidence obtained at the time of Childs arrest and used by the State for Childs conviction in a bench trial.
